Terms and Conditions

Please read these terms carefully before using our services.

1. Acceptance of Terms

By accessing our website at myblueprint.co.za or engaging our web design services you confirm that you have read, understood and agree to be bound by these Terms and Conditions and our Privacy Policy.

If you do not agree to these terms please do not use our website or services.

These terms apply to all visitors, clients and anyone who accesses or uses our services.

2. Our Services

MyBlueprint (Pty) Ltd provides professional web design and development services including:

  • Custom website design and development
  • Mobile-responsive website builds
  • Ongoing website hosting and maintenance
  • Monthly content updates and support
  • Branding and marketing asset creation

The specific scope of services for each client is confirmed in the individual Service Agreement signed prior to commencement of work.

3. Service Agreements

All web design projects require a signed Service Agreement before work commences. The Service Agreement outlines:

  • The specific package and services to be delivered
  • The setup fee and monthly retainer amounts
  • Delivery timelines and revision rounds
  • Payment terms and methods
  • Ownership of the completed website

The Service Agreement is legally binding and forms the basis of our contractual relationship. Digital signatures on our Service Agreement are legally valid under the Electronic Communications and Transactions Act No. 25 of 2002 (ECT Act).

4. Payment Terms

Setup fees are due upon signing the Service Agreement and before development commences.

Monthly retainers are billed on the 1st of each month starting from the month the website goes live.

Accepted payment methods:

  • EFT bank transfer to our FNB account
  • Card payment via PayFast
  • Cash by prior arrangement

Late payments of more than 7 days may result in services being suspended including the website being taken offline until payment is received.

MyBlueprint reserves the right to charge interest of 2% per month on overdue amounts.

All prices are quoted in South African Rand (ZAR) and are inclusive of any applicable taxes unless stated otherwise.

5. Website Ownership

Upon receipt of the full setup fee the completed website design and all associated files become the property of the client.

MyBlueprint retains the right to:

  • Display the website in its portfolio and marketing materials
  • Reference the project as a case study with the client's consent
  • Credit MyBlueprint as the developer in the site footer

If the monthly retainer is cancelled MyBlueprint will deliver all website files to the client within 7 business days so the client can host the site independently.

6. Client Responsibilities

The client agrees to:

  • Provide all required content, images, logos and information in a timely manner
  • Review and provide feedback on the demo within 5 business days of delivery
  • Make all payments on time as agreed in the Service Agreement
  • Ensure all content provided to MyBlueprint does not infringe on any third party intellectual property rights
  • Not make unauthorised technical changes to the website that could affect its security or performance
  • Notify MyBlueprint of any issues via WhatsApp or email promptly

7. Intellectual Property

All original design concepts, code, graphics and creative work produced by MyBlueprint remain the intellectual property of MyBlueprint until full payment of the setup fee is received.

Content provided by the client (text, images, logos, branding) remains the intellectual property of the client. By providing this content the client confirms they have the right to use it and grants MyBlueprint permission to incorporate it into the website design.

MyBlueprint is not responsible for any intellectual property infringement resulting from client-provided content.

8. Cancellation Policy

Monthly retainer cancellations require 30 days written notice via email to myblueprintsa@gmail.com.

Upon cancellation:

  • All work completed up to the cancellation date will be billed
  • No partial month refunds will be issued
  • All website files will be delivered to the client within 7 business days of cancellation
  • The client retains full ownership of the completed website

MyBlueprint reserves the right to terminate services immediately if the client breaches any material term of the Service Agreement.

9. Limitation of Liability

MyBlueprint's total liability to the client for any claim arising from our services is limited to the total setup fee paid by the client.

MyBlueprint is not liable for:

  • Loss of business, revenue or profits resulting from website downtime
  • Third party service outages (hosting providers, domain registrars, payment processors)
  • Content provided by the client that infringes on copyright or trademarks
  • Any indirect, special or consequential losses arising from the use of our services
  • Damages resulting from unauthorised access to or alteration of your website by third parties

10. Disclaimers

Our website and services are provided on an as-is and as-available basis. MyBlueprint makes no warranties, express or implied, regarding:

  • The uninterrupted or error-free operation of the website
  • The accuracy or completeness of any information on our website
  • Results that may be obtained from using our services

SEO and search engine rankings cannot be guaranteed as they are determined by third party search engines beyond our control. We implement SEO best practices but do not guarantee specific ranking positions.

11. Governing Law

These Terms and Conditions are governed by and construed in accordance with the laws of the Republic of South Africa.

Any disputes arising from these terms or our services will be subject to the jurisdiction of the courts of Cape Town, Western Cape, South Africa.

Both parties agree to attempt to resolve any dispute through good faith negotiation before resorting to legal proceedings.

12. Changes to Terms

MyBlueprint reserves the right to update these Terms and Conditions at any time. Changes will be effective immediately upon posting to our website.

Continued use of our services after any changes constitutes your acceptance of the new terms.

We recommend reviewing these terms periodically.
